The NAC assessment: areas for issuing driving licenses and transport registration, severely affected by corruption risks
07.09.2021 859 ViewsAn assessment of the institutional integrity carried out by the NAC at the Department of Registration of Transport Means and Driver’s Qualification of the Public Services Agency has found several risks of corruption that would affect the daily activity of the institution.
Among the main risks identified are: the risk of fraud in the results of the car qualification exam, favoring candidates, active / passive corruption and influence peddling.
The existence of these risks of corruption is demonstrated, moreover, by the fact that more and more people who claim that they can influence officials responsible for assessing knowledge in the car qualification exam are detained in flagrante delicto by the NAC officers, in 2019 - 6 months of 2021.
The amounts extorted by intermediaries to favor the obtaining of the “admitted” qualification for a single sample vary between 350 and 500 Euros, and for both samples (theoretical and practical), the extorted bribe reaches up to 1000 Euros, depending on the geographical area of the country.
The causes of these manifestations of corruption would derive from the procedure of conducting the examination and the conditions for obtaining the right to drive vehicles, which is a defective one. Thus, some candidates are admitted to the exam in the absence of prior appointment. Another problem refers to the fraudulent realization of some appointments, which are later used in the interest of other people, against illicit remuneration. Such services are freely offered through social networks as well.
At the same time, the practice of unilateral distribution of candidates' files to certain examiners at the practice test would create conditions for corruption schemes.
Another aspect, identified during the institutional integrity assessment, relates to the regulatory framework regarding the vehicle registration procedure, which is defective and abusive. Thus, by admitting the registration and transfer of ownership of vehicles in national or international search, as well as vehicles with the identification number intentionally, falsified or counterfeit, would create conditions for the legalization of possible criminal schemes.
At the same time, the regulatory framework on road safety attributes excessive powers to some authorities, capable of generating abuses. An example in this respect would be the defective norms related to the procedure for destroying driving licenses, but also the discriminatory norms regarding the procedure for changing the driving license obtained in the Transnistrian region.
We note that the impact of these risks is serious and violates fundamental human rights and freedoms, including the right to life and physical integrity.
Thus, in order to eliminate the risks of corruption, the NAC formulated and presented to the evaluated public entity, including the Government and the line ministries, a series of recommendations, the implementation of which is to be monitored later.

We remind that the institutional integrity testing is a mechanism provided by law, through which the NAC identifies the institutional factors and vulnerabilities that favor or may favor corruption and elaborates recommendations that would exclude their effects.
