Several recent draft laws and government decisions have been submitted to the NAC's anti-corruption expertise. Among the most important normative acts this week are the draft laws on amending the Road Law, the Law on Pharmaceutical Activity, the Law on Public Procurement, but also the Customs Code of the Republic of Moldova. Thus, in the expert reports, elaborated by the NAC, deficient norms were identified and recommendations were submitted to remove their effects.
According to the experts, the draft law on amending the Road Law, which aims to create infrastructure for cyclists and pedestrians, contains risks of implementing the rules of the project in practice. These may generate additional costs for the district and municipal public budgets, even if according to the project, the runway works would be incorporated in the rehabilitation works of the roads of district or municipal interest. To avoid these additional costs, the NAC recommends that more attention is to be paid to the drafting of law enforcement regulations.
Also, several risks were identified in the Draft Law on Amending the Law on Pharmaceutical Activity. The NAC report has mentioned that it could create favorable conditions for the import of fake or counterfeit medicines, which would later harm the health of citizens.
The Draft Law on Amending the Customs Code of the Republic of Moldova, recently submitted to the anti-corruption expertise of the NAC, proposes to remove the ban on the import of used parts for vehicles.
According to the expert report, the problem identified in the draft law refers to the fact that the removal of the respective ban is unconditional. The project does not set import requirements. Thus, this would allow the import of any parts and accessories: original or not; reusable or not; accompanied or not by documents of origin or confirming the quality, etc.
We remind you that the anti-corruption expertise is the process of identifying the risks of corruption that may arise when promoting draft legislative and normative acts by public entities, the factors that generate them and the elaboration of recommendations to remove their effects.
