The head of the legal service of a penitentiary and an intermediary, investigated by the NAC for influence peddling, were referred to justice
22.05.2023 193 ViewsThe Anticorruption Prosecutor's Office announces the completion of the criminal investigation and referral to the court for substantive examination, of the criminal case accusing a head of the Legal Service of a penitentiary of the National Penitentiary Administration and an intermediary, being charged with the commission of a traffic offense of influence (art. 326 par. (1) of the Criminal Code).
The criminal investigation was started in January 2023, by the criminal investigation body of the National Anticorruption Center based on a whistleblowing.
According to the whistleblowing, the defendant claimed to have influence over the judge to get him to grant an inmate's appeal for parole and commute the unserved portion of the sentence to a lighter sentence. Respectively, in order to achieve the alleged influence, he received from the detainee through an accomplice, monetary means in the amount of 2000 euros, their transmission being carried out under the control of the NAC officers.
The accused did not admit their guilt, and the criminal case was sent for substantive examination to the Chisinau Court, Buiucani headquarters.
For the crime committed, the law provides for the punishment in the form of a fine ranging from 100,000 to 150,000 lei or imprisonment of up to 6 years.
At the same time, in order to guarantee the execution of the penalty of the fine and the extended confiscation, a seizure was applied on ½ part of the value of the building, which constitutes 224,966 MDL lei, which belongs to one of the accused with the right of ownership.
Note: A person accused of committing a crime is presumed innocent until proven guilty by a final court decision.
