NAC imposed fines worth over 2 million lei for electoral corruption. Currently, about 1000 minutes, received from the Police, are in the process of examination
30.10.2024 47 ViewsThe National Anti-corruption Centre has informed about the application of contravention fines in the amount of over 2 million lei for electoral corruption, up to now, and at this stage the institution has for examination about 1000 minutes of ascertaining the contravention provided by art. 47 first Criminal Code - passive electoral corruption, received from the Police. According to the legislation in force, for committing this contravention, a fine from 25,000 lei to 37,500 lei is provided.
We specify that passive electoral corruption provides for the ascertainment of claims, acceptance or receipt, personally or through an intermediary, by a voter of undue goods, services, privileges or advantages in any form, for himself/herself or for another person, for the purpose of exercising or not exercising electoral rights during the elections.
The NAC points out that the person who committed the contravention act is released from contravention liability if he/she self-reported and/or actively contributed to the discovery or countering of the commission of the act of electoral corruption. We also remind that people who offer money to influence the results of an election risk from one to 5 years in prison and a fine of over 50 thousand lei, and the illegal financing of political parties from prohibited sources is punishable by up to 6 years in prison and a fine of over 67 thousand lei. To ensure the recovery of the damage, legal institutions can apply seizure on the person's assets.
Article 47first was introduced by Law no. 230 of 31.07.2024 and entered into force on 15.08.2024, and the competence was assigned to the National Anti-corruption Centre.
