Lawyer, referred to justice for committing two crimes of influence peddling

The lawyer, detained on November 22, 2022 by the officers of the General Territorial Directorate North of the NAC and the anti-corruption prosecutors, was referred to justice for committing two crimes of influence peddling.

The criminal investigation was started by the criminal investigation body of the General Territorial Directorate North of the National Anticorruption Center (NAC) on September 26, 2022, based on the notification of a citizen, who is charged with a criminal case of theft and who was in house arrest.

According to the notification, the lawyer, starting on August 9, 2022, claiming to have influence on the judge of the Drochia Court, Central Headquarters, demanded money from the whistleblower in the amount of 1000 euros (later increasing the amount to 4000 euros, to influence the magistrate and to issue the acquittal in the criminal case of the whistleblower.

In the same case, the lawyer also claimed 1,500 euros in money, to persuade the prosecutor and the magistrate to replace the preventive measure in the form of house arrest with a non-custodial measure.

The claimed amount of 1500 euros was received by the lawyer under the control of the NAC before the court hearing that took place on October 5, 2022.

On November 22, 2022, the lawyer received and accepted the alleged amount of 4,000 euros under the control of the NAC, being detained on the same day. At the time of the lawyer's detention, 4000 euros were found and collected, and with a view to the possible special confiscation of the amount of 1500 euros, a seizure was applied to the movable assets of the accused.

The lawyer was in preventive detention until January 4, 2023, later the Balti Court of Appeal, examining the appeal of the lawyer and the accused, ordered the change of the preventive measure, applying his provisional release under judicial control for a period of 60 days, which expires on 5 March 2023.

The accused does not admit his guilt, and the criminal case was referred to the judiciary, to be examined by the Bălți Central Court.

If found guilty of committing the named crime, the defendant risks a prison sentence of up to 6 years or a fine ranging from 100,000 lei to 150,000 lei for each charge.

Note: Every person accused of committing a crime shall be presumed innocent until proven guilty by a final court decision.
