Prosecutor, referred to justice for coercion to testify and disclose the data of the criminal investigation

The Anticorruption Prosecutor's Office has announced the completion of the criminal investigation and referral to the court for examination of the criminal case of indictment of a prosecutor from Chisinau, being charged with the crime of coercion to testify and  disclose the data of the criminal investigation (art. 309 and Article 315 paragraph (2) of the Criminal Code).

The criminal investigation was started in December 2021, by the Anticorruption Prosecutor's Office based on a complaint.

According to the results of the criminal investigation carried out by the NAC and SIS officers, it was established that the accused, during the period February 2020 - September 2021, holding the position of prosecutor in the General Prosecutor's Office, carrying out the criminal investigation in a criminal case, carried out illegal acts of influence on a witness, in order to compel the submission of statements in favor of the injured party in that case.

He also, carrying out the criminal investigation in the same criminal case, intentionally disclosed the data of the criminal investigation regarding the administered evidence and the persons concerned in the criminal investigation, which were made public in the mass media, actions through which he caused moral and material damages of approximately 10 million lei to the trial participants.

The accused did not admit his guilt, and the criminal case was sent for examination to the Chisinau Court, Buiucani headquarters.

For the crime committed, the law provides for the punishment in the form of imprisonment from 2 to 6 years with a fine in the amount of 57,500 to 67,500 lei, in both cases with the deprivation of the right to hold certain positions or to exercise a certain activity on a a term of 5 years (in the case of art. 309 of the Criminal Code) and a fine ranging from 42,500 to 67,500 lei with the deprivation of the right to hold certain positions or to exercise a certain activity for a term of up to 3 years (in the case of art. 315 paragraph 2 of the Criminal Code).

Note: A person accused of committing a crime is presumed innocent until proven guilty by a final court decision.
