The Chisinau Court, Buiucani, found a man guilty of committing the crime of influence peddling (art. 326 para. (2) letter c) of the Criminal Code). The court ordered a fine of 150,000 lei and admitted the civil action filed by the National Anti-corruption Centre (NAC) regarding the collection of the amount of 12,000 euros from the defendant's account.
According to the evidence accumulated by the Anti-corruption Prosecutor's Office (AP) jointly with the National Anti-corruption Centre (NAC), in June 2023, the defendant allegedly told his acquaintances, who had the status of a suspect in a criminal case, that he could influence the criminal investigation officer and the prosecutor in charge of the criminal case and could determine them to remove them from criminal investigation and close it. In order to exercise the promised influence, the defendant allegedly demanded and received funds in the amount of 12,000 euros, which were transferred under the control of the NAC.
At the end of the examination of the criminal case in court, the defendant admitted his guilt. In addition to establishing guilt and imposing the sentence, the court maintained the seizure applied to the defendant's assets, in order to guarantee the execution of the sentence with a fine.
Since the state prosecutor requested the application of a custodial sentence, the need to challenge the sentence by appeal to the Chisinau Centru Court of Appeal is to be decided.
Note: The person accused of committing a crime shall be presumed innocent until his guilt is established by a final court decision.
