Several employees of the NBM, are under criminal investigation for the abuse of office. They allegedly tried to help a group of shareholders take control of a bank

Four employees, with managing positions within the National Bank, are being criminally investigated by the NAC and anticorruption prosecutors in a case of the abuse of office. The civil servants are suspected that they would have tried to help a group of shareholders of a commercial bank in the Republic of Moldova to take control of the bank entity, causing damage in particularly large proportions to other shareholders.
According to the ordinance of initiating the criminal prosecution in this case, there have been identified reasonable suspicions that , during 2018-2019, the officials with the positions of public dignity from the National Bank of Moldova, actioning intentionally to favor a group of shareholders of the Bank of Finance and Commerce (Bănca de Finanțe și Comerț SA), that wanted to take control of the bank, ignoring the known information and misinterpreting factual and legal situations, created conditions and prepared acts with distorted information, that served as a background for abusive issuing of the Decision no.15 of the Executive Committee of January 11, 2019 regarding the actions focused on shareholders of the Bank of Finance and Commerce, followed by the suspension of some afferent rights of the shareholder quality and the obligation to alienation of some actions within 3 months.
The mentioned administrative acts infringed the property rights of several shareholders who, cumulatively, owned 35,15 % of shares of the Bank of Finance and Commerce, qualified as natural and legal persons to cause financial damages in particularly large proportions that exceeds the amount of 123 million leis, due to forced alienation of the shares, at the price clearly reduced to the market price.
Thus, from the notification act and collected materials, there is reasonable suspicion of the use by public persons and with a function of public dignity of the service situation, the actions that caused damages to the rights and interests protected by law of natural and legal persons, in the interest of some third parties, namely committing offences provided in art. 373 lit. b) and b1) of the Criminal Code of the RM – abuse of office.
Today, the NAC and anticorruption prosecutors have carried out the actions of criminal investigation against those four employees of the NBM to collect the evidence in the present criminal case. The officials are investigated at large, until the final and irrevocable decision of the court is pronounced, they benefit from the presumption of innocence.
The Anticorruption Prosecutor’s Office is carrying out the criminal prosecution.
